Vicentin: Lorenzini ya tiene el expediente y comienza la cuenta regresiva para el futuro de la concursada

En el día de ayer el Juez Fabián Lorenzini, a cargo del Juzgado Civil y Comercial de Reconquista recibió de nuevo en su despacho el voluminoso expediente concursal de Vicentin SAIC.

Después de más de 8 meses de que el Dr. Rafael Gutierrez, entonces Presidente de la Corte Suprema santafesina ordenara la suspensión de los términos judiciales y el avocamiento del proceso judicial solicitado por un acreedor y después de casi 3 meses de la sentencia del Máximo Tribunal que rechazo ese pedido y ordeno su devolución, en el transcurso de la presente fecha ya se encuentra de nuevo a disposición del titular del juzgado local.

Es por eso que en las próximas horas el Magistrado local deberá sacar una resolución donde reanuda los plazos procesales suspendidos desde el 16 de junio del año pasado.

Asimismo, deberá darle curso a todos los escritos judiciales de la Concursada, Sindicatura y Acreedores que se fueron presentando durante todos estos meses y que no tuvieron su resolución en virtud de encontrarse el expediente en Santa Fe.

También tendrá que reordenar todos los plazos procesales que estaban vigentes antes de la suspensión, como por ejemplo que a la Concursada Vicentin SAIC le queda todavía 14 días del “periodo de exclusividad”, como cualquier otro plazo que estaban prefijados, antes de la suspensión ordenada por el Presidente de la Corte, como la fecha de apertura del posible cramdown (salvataje empresarial).

Por ultimo tendrá que ir viendo las fechas de la resolución de propuesta concursal, las posibles impugnaciones judiciales que puedan interponer los acreedores disconformes con la Propuesta y la fecha para resolver si el acuerdo es homologable judicialmente o lo rechaza por violación de algunas de las causales que invoca la Ley Concursal.

Es por todo eso que ahora el juez Lorenzini deberá trabajar a contrareloj, ya que Vicentin le manifestó a la Corte que se encuentra en una crítica situación económica y es por eso que el magistrado local deberá resolverlo durante los meses de marzo y abril.

Vicentin: Lorenzini already has the file and the countdown for the future of the bankrupt company has begun

Today Judge Fabián Lorenzini, in charge of the Civil and Commercial Court of Reconquista, has again in his office the voluminous bankruptcy file of Vicentin SAIC.

After more than 8 months since Dr. Rafael Gutierrez, then President of the Supreme Court of Santa Fe, ordered the suspension of the judicial terms and the legal proceedings requested by a creditor and after almost 3 months since the decision of the Highest Court that rejected that request and ordered its return, during the course of the present date it is already back at the disposal of the head of the local court.

That is why in the next few hours the local Magistrate must issue a resolution where he resumes the procedural terms suspended since June 16 of last year.

Likewise, he will have to give course to all the judicial writs of the Bankrupt Party, Trustee and Creditors that were presented during all these months and that did not have their resolution by virtue of the fact that the file was in Santa Fe.

It will also have to reorder all the procedural deadlines that were in force before the suspension, such as the fact that the Bankrupt Vicentin SAIC still has 14 days left of the “exclusivity period”, as well as any other deadline that was fixed before the suspension ordered by the President of the Court, such as the date of the opening of the possible cramdown (corporate rescue).

Finally, the dates of the resolution of the insolvency proposal, the possible legal challenges that may be filed by creditors who disagree with the Proposal and the date to decide whether the agreement is judicially homologated or rejected for violation of some of the grounds invoked by the Insolvency Law will have to be considered.

For all these reasons, Judge Lorenzini will now have to work against the clock, since Vicentin has told the Court that it is in a critical economic situation and that is why the local magistrate will have to resolve the matter during the months of March and April.
